Wrongful Death: Tree Service Worker Dies in Bucket Truck Accident

An American Tree Service worker suffered a Workers Compensation accident and died in a bucket truck accident Wednesday November 12, while working in a cemetery in Zelienople. According to the police and the Butler County Coroner the accident happened as a result of faulty equipment-machinery in the truck not working properly.

The victim was found by his coworkers next to the bucket truck. None of the tree service co-employees witnessed the accident but said they had seen the deceased worker shortly before up in the bucket truck working.

The Butler County Chief Coroner said the from the man's injuries the man did not fall from the bucket truck. It appears from his head injuries he sustained that the bucket truck came down and struck a cemetery headstone which then caused the employee to be ejected who then crashed into the truck causing the significant traumatic injury leading to his death.

Police are currently investigating the situation but it appears as if this is only a work accident. 

Because the man was working on the job when the accident occurred his spouse and dependents can file a claim for Workers Compensation benefits. When a worker is injured on the job in the course of their employment they are entitled to payment of medical bills and wage loss for their time off of work. However if they die as a result of an accident while in the course and scope of their employment, an on the job injury causing death, the widow and dependents (children under 18 or incapacitated children) are entitled to widow's and dependent compensation benefits.

If it is determined that the machine or the truck was somehow defective then a product liability claim may be filed against the manufacturer of the truck or device. Manufacturers are responsible for providing safe and reliable products, equipment, and machinery for consumers.
