An on-the-job injury could mean a personal injury claim

Many people are aware that workers' compensation benefits can help cover the costs associated with any injuries suffered on the job, but for some people, workers' compensation benefits are not enough. Depending on the injury, the healthcare costs might be extremely high, and it may be impossible for the victim to ever return to work. Such serious injuries require a much more comprehensive and extensive amount of compensation and, depending on the circumstances, that compensation could come from a personal injury claim.

A personal injury lawsuit occurs when an injured victim attempts to hold another person or party responsible for the incident that caused the injury. It is illegal in Pennsylvania to sue employers, which means that you will have an extremely difficult time taking legal action against your employer for injuries suffered on the job, but there may be another party responsible for your injuries.

Imagine, for instance, that you do construction work around heavy machinery such as tractors, jackhammers and more. If a defect in one of those large machines causes you to be injured, you may be able to bring a personal injury claim against the manufacturer of the machine or device. If you can prove that the design or manufacture of the machine directly contributed to your injury, then the company may be held partially or fully responsible for your injuries.

If you suffer an injury on the job, you should always inform your employer as soon as possible. However, if you feel that workers' compensation benefits are not enough to cover your injuries, or if your workers' compensation claim is denied, please visit our web page. We can offer legal expertise and advice on how you can proceed in either recovering the workers' compensation you deserve or taking legal action to hold the responsible party accountable for your injuries.
