Work Injury? What next? A List of Important things to know.

Notice. You must report your injury to your employer. Generally you have up to 120 days from the date of your injury to report it to someone in a supervisory capacity. You must give sufficient notice so that your employer and insurance carrier can make an investigation and a decision on your claim. Typically reasonable notice means telling them what part of your body you injured and how you did it.

Time limits. In addition to 120 days from the injury to report the injury you have other time limits. You must treat with one of your employer's posted panel of physicians for 90 days starting from the day of first treatment. If your employer doesn't have a panel of doctors you can treat where you want in those 90 days. After the 90 days has elapsed you can treat anywhere you want also.

You have up to 3 years from the date of injury to file a claim for compensation benefits or you will be barred under the statute of limitations.

Medical treatment. You should continue to treat for your injuries. Failure to follow treatment that can reasonably be performed to help decrease your disability if not followed can be a bar to benefits.
