The Workers’ Compensation Act and the Pennsylvania Heart and Lung Act covers state police, enforcement officers, investigators, parole agents, correction employees, psychiatric security aides, drug enforcement agents, policemen, firemen, park guards, sheriffs, and deputy sheriffs.
These are difficult and often physical positions, which we as citizens rely on everyday for our safety and to allow us to go about our daily lives. Accordingly, the legislature has created additional benefits for such categories of workers under the Pennsylvania Heart and Lung Act as opposed to under the general provisions of The Workers’ Compensation Act.
The Pennsylvania Heart and Lung Act provides that if those workers are injured in the performance of their duties and are temporarily incapacitated from performing their duties from those injuries they shall be paid by the Commonwealth of Pennsylvania their full rate of salary until the disability has ceased. The full rate of salary being the primary difference between the two Acts. The other difference, one which often is the subject of much litigation is that the employee must be temporarily incapacitated.
In addition all medical and hospital bills incurred as a result of those injuries sustained in the performance of their duties will be also paid by the Commonwealth of Pennsylvania.
Furthermore, since the injured employee would be entitled to Workers’ Compensation because of an on the job injury any workers’ compensation received or collected by the employee shall be turned over to the Commonwealth of Pennsylvania or deducted from the salary or benefits thereafter becoming due and owing.
