Workers' Compensation Panel List Medical Providers- Work Injury

The Pennsylvania Workers' Compensation Act requires employees hurt on the job to treat with a designated medical provider for the first 90 days of treatment. Your employer is not required to comply with this section of the law but if they do there are very specific rules they have to follow and if they don't you can treat with whomever you choose for your work injury. Your employer is required to have you sign a written acknowledgement twice. Once prior to your work injury (typically at the time you are hired) that you were advised of their list of panel providers to treat with for your workers' compensation injury AND at the time of your work injury or as practically possible. It is very common for employers not to have their injured workers sign an acknowledgement at the time of the work injury. If they don't do both you are not required to treat with the employers workers' compensation panel of doctors or providers.

Thus:

1. Is there a designated list of medical providers posted in a place where you as an employee, injured worker, can see it?

2. Did you sign a written acknowledgement that you were notified of this list prior to your work injury?

3. Did you sign a written acknowledgement at the time of your work injury?

If your employer did cooperate with the Pennsylvania workers compensation laws of posted panel providers then you must treat with their physicians or groups for the first 90 days of treatment.

If you do not comply then the workmens compensation insurance carrier is not responsible for payment of your medical treatment for a certain period of time for your work injury.

If your employer has not complied with the PA Workers Compensation Act then you can treat with whomever you choose for your work injury.
